Please read these Terms of Service ("Terms") carefully before using ETF Navigator Pro ("Platform"), operated by ETF Navigator Pro ("we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
01 Acceptance of Terms
By creating an account or accessing any part of the Platform, you confirm that you are at least 18 years of age, that you have read and understand these Terms, and that you agree to be bound by them. These Terms constitute a legally binding agreement between you and ETF Navigator Pro.
02 Description of Services
ETF Navigator Pro is a financial analysis and portfolio tracking platform that provides tools for:
- ETF research, comparison, and overlap analysis.
- Portfolio tracking, performance analysis, and dividend monitoring.
- Tax analysis and tax-loss harvesting identification.
- Broker CSV import from supported brokerage platforms.
- Portfolio optimization tools and rebalancing suggestions.
The Platform is offered under three subscription tiers:

03 Not Financial Advice
You should not make investment decisions based solely on information provided by the Platform. Always consult with a qualified financial advisor, tax professional, or attorney before making investment decisions. Past performance of any ETF or investment does not guarantee future results.
We make no representations or warranties regarding the accuracy, completeness, or timeliness of any financial data displayed on the Platform, which is sourced from third-party data providers.
04 User Accounts
Account Creation
To access most Platform features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@etfnavigatorpro.com if you suspect any unauthorized use of your account.
Account Termination
We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or engaged in conduct that is harmful to other users, us, or third parties.
05 Subscriptions and Payments
Subscription Plans
Paid subscriptions (Premium and Pro) are billed on a monthly basis. You authorize us to charge your payment method on file through our payment processor, Stripe, at the beginning of each billing cycle.
Free Trial
We may offer free trial periods for paid subscription tiers at our discretion. At the end of any free trial, your account will automatically convert to the applicable paid plan unless you cancel before the trial ends.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for partial billing periods, except where required by applicable law.
Price Changes
We reserve the right to modify subscription prices with at least 30 days' advance notice. Your continued use of the Platform after a price change takes effect constitutes your acceptance of the new pricing.
Taxes
You are responsible for any applicable taxes, levies, or duties imposed by taxing authorities on your subscription fees, except for taxes based on our net income.
06 User Content and Data
Your Data
You retain ownership of any portfolio data, transaction records, and other content you upload or input into the Platform ("User Content"). By using the Platform, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide the Platform's services to you.
Acceptable Use of CSV Imports
When importing brokerage CSV files, you represent that you have the lawful right to use and upload that data. You agree not to upload data belonging to third parties without authorization.
Data Accuracy
You are responsible for the accuracy of data you input into the Platform. We are not liable for errors in analysis, reporting, or recommendations that result from inaccurate or incomplete data you provide.
07 Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Platform or its underlying systems.
- Reverse engineer, decompile, or disassemble any portion of the Platform.
- Use automated tools, bots, or scrapers to extract data from the Platform without our written consent.
- Reproduce, redistribute, or resell any financial data or analysis obtained through the Platform.
- Upload or transmit viruses, malware, or any other harmful code.
- Impersonate another person or misrepresent your affiliation with any entity.
- Use the Platform in any manner that could damage, disable, or impair our systems or servers.
08 Intellectual Property
All content, features, and functionality of the Platform — including but not limited to software, algorithms, user interface design, graphics, text, and logos — are owned by ETF Navigator Pro and are protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal or internal business purposes. This license does not include the right to reproduce, modify, distribute, or create derivative works from any portion of the Platform.
09 Third-Party Data and Services
The Platform integrates financial data from third-party providers, including Financial Modeling Prep and Marketstack. This data is provided as-is and we do not guarantee its accuracy, completeness, or timeliness. We are not responsible for errors or omissions in third-party data.
The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites.

11 Indemnification
You agree to indemnify, defend, and hold harmless ETF Navigator Pro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.
12 Modifications to the Platform and Terms
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice. We also reserve the right to update these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new effective date and, where appropriate, by email. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
13 Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the unauthorized use of intellectual property.
You agree to resolve any disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
14 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ETF Navigator Pro regarding your use of the Platform and supersede all prior agreements, understandings, or representations.
